Donald Trump cannot invoke presidential immunity as a defense against criminal charges that accuse him of attempting to overturn the 2020 presidential election and inciting a violent insurrection at the Capitol, a panel of federal judges ruled on Tuesday.
“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” wrote for the panel of three judges who serve in the U.S. Court of Appeals for the D.C.
Earlier on Thursday, Trump posted to social media about the issue of presidential immunity – almost as if he had advance notice about the decision.
“IF IMMUNITY IS NOT GRANTED TO A PRESIDENT, EVERY PRESIDENT THAT LEAVES OFFICE WILL BE IMMEDIATELY INDICTED BY THE OPPOSING PARTY.
The decision on presidential immunity was hardly unexpected.
